Introduction
These General Promotion Terms and Conditions apply to all promotions, giveaways, competitions, contests, prize draws, discount campaigns, and incentive-based offers (each referred to as a “Promotion”) run by Affiliate Choice through the Website, email communication, social media channels, or any other official platform. By entering or participating in any Promotion, You agree to be bound by these Terms. Additional Promotion-Specific Terms may apply, and in the event of a conflict, the Promotion-Specific Terms will take precedence.
Affiliate Choice reserves the right to update or amend these Terms at any time. Your continued participation in a Promotion following any amendments will be treated as acceptance of the revised Terms.
1. Eligibility
Unless stated otherwise in the Promotion-Specific Terms:
- Promotions are open to individuals aged 18 or over.
- Entrants must have lawful capacity to participate.
- Employees, contractors, and partners of Affiliate Choice, as well as their immediate family members, are not eligible to enter.
- Promotions may be restricted based on geographical location, platform rules, or legal requirements.
Affiliate Choice reserves the right to request proof of age or identity before confirming any prize or promotional entitlement.
2. Entry Requirements
To participate in a Promotion, Entrants must follow the instructions provided in the relevant promotional material or Promotion-Specific Terms. This may include actions such as submitting a form, following a social media page, making a purchase, interacting with a post, or joining a mailing list.
- Entrants must provide accurate and truthful information.
- Automated, bulk, or fraudulent entries are prohibited and will be disqualified.
- Entries submitted after the closing date will not be accepted.
- Affiliate Choice is not responsible for technical issues that may prevent entry submission.
3. No Purchase Necessary
Unless stated otherwise in the Promotion-Specific Terms, no purchase is required to enter a Promotion.
4. Promotion Period
Each Promotion will run for the duration stated in the Promotion-Specific Terms. If no start or end date is provided, Affiliate Choice reserves the right to determine and amend the Promotion period at its discretion.
5. Prizes and Rewards
- Prizes, rewards, or discounts offered in Promotions are non-transferable and may not be exchanged for cash or alternatives unless explicitly stated.
- Affiliate Choice reserves the right to substitute any prize with an item of equal or greater value if required for reasons outside our control.
- Digital prizes, including Premium Packs and downloadable content, will be delivered via email or through the Affiliate Choice system.
- Physical items, if offered, may be subject to delivery restrictions depending on location.
Affiliate Choice is not responsible for third party products or services offered as prizes.
6. Winner Selection and Notification
For competitions or prize draws:
- Winners will be selected at random or based on judging criteria specified in the Promotion-Specific Terms.
- Decisions made by Affiliate Choice or its appointed judges are final and binding.
- Winners will be notified using the contact details provided at the time of entry.
- If a winner does not respond within 72 hours, Affiliate Choice reserves the right to select an alternative winner.
Affiliate Choice accepts no responsibility for email or message delivery failures.
7. Publicity and Use of Entrants’ Content
By entering a Promotion, You agree that Affiliate Choice may, where lawful, use Your name, social media username, city of residence, or submitted content for promotional purposes. This may include:
- Publishing winner announcements
- Using submitted entries in marketing materials
- Sharing entry content across Affiliate Choice platforms
You grant Affiliate Choice a non-exclusive, royalty-free licence to use any content submitted for the Promotion. You may withdraw this consent by contacting us, unless the content has already been publicly used.
8. Data Protection
Personal information submitted as part of a Promotion will be handled in accordance with the Affiliate Choice Privacy Policy. This may include collection of:
- Names
- Email addresses
- Social media handles
- Postal addresses (when required)
- Entry submissions or responses
Data may be used to administer the Promotion, contact winners, and verify eligibility.
Affiliate Choice does not sell or distribute Entrant information to third parties, except where necessary for prize fulfilment or where required by law.
9. Disqualification
Affiliate Choice reserves the right to disqualify any Entrant who:
- Provides false or misleading information
- Breaches these Terms or any Promotion-Specific Terms
- Attempts to manipulate or unfairly influence the Promotion
- Uses scripts, bots, or automated systems to enter
- Engages in abusive or inappropriate behaviour toward Affiliate Choice staff or participants
Decisions regarding disqualification are final.
10. Liability
To the fullest extent permitted by law, Affiliate Choice will not be liable for:
- Losses, damages, or injuries arising from participation in a Promotion
- Technical issues, lost entries, or system failures
- Failure of third party providers or prize suppliers
- Delays or inaccuracies in prize delivery
- Indirect or consequential losses
Nothing excludes liability for fraud or any harm that cannot legally be excluded.
11. Cancellation or Modification of Promotions
Affiliate Choice may cancel, amend, or suspend a Promotion if it cannot be carried out as planned due to circumstances beyond our control, including technical issues, fraud, or legal obligations. If a Promotion is cancelled, no compensation will be provided.
12. Governing Law
These Terms and any Promotion-Specific Terms are governed by the laws of England and Wales. Any disputes arising from or related to a Promotion will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
